Frequently asked questions
Commissioning of the dwelling
The commissioning of the dwelling takes place under the following conditions:
- the notification of the readiness for commissioning is sent,
- 100% of the price specified in the contract is paid and credited to the Vendor's account,
- payment for the dweller's changes is made,
- payment for interest is made.
The notifications of the readiness for commissioning are sent the Customer Service Office (BOK) in accordance with the terms contained in the preliminary/development contracts.
Notarial deeds
In order to proceed to the notarial deed, the following must be completed:
- payment of up to 100% of the contract value, in accordance with the payment schedule attached to the preliminary contract,
- payment related to possible dweller’s changes,
- payment of any financial obligations, including exploitation charges and any interest,
- charges for the use of perpetual usufruct of land for the period from the date of signature of the notarial deed to the end of the calendar year (where the purchased dwelling are built on land delivered for perpetual usufruct).
The date of readiness for the deed to be signed is notified by registered letter and by e-mail, while the level of the above-mentioned fees will be notified within 7 days of the contact regarding the setting of the time limit. The exact date for the deed will be fixed once all the fees are paid. The draft notarial deed together with the amount of the charges associated with signing the deed will be sent to you by the notary office at the e-mail address given in the contract within 3 days before the agreed date of signing the contract establishing separate ownership of the dwelling.
Charges for dwelling upon commissioning
In accordance with the signed preliminary/developer contract and the commissioning protocol for the dwelling, you take over all the charges associated with the maintenance of the dwelling, the box room and the garage place from the date the subject matter of the contract is handed over.
The fees are paid as a lump sum, so, in accordance with the lump sum principle, it is a monetary liability of an amount fixed in advance without settling the costs. After the building is built, a geodetic measurement is carried out and transferred to the office, so that the file for the building to be established for the final contract transferring ownership. Therefore, the lump sum fee is calculated from the area after measurement which may differ slightly from the one included in the contract.
The fee is calculated for:
- m2 of the dwelling
- garage place (charge is applied for each parking place, meaning that in the case of a family place, the charge reflects 2 places)
- m2 of the box room (if any), as it is part of the dwelling. In accordance with the Act on the Ownership of Dwellings of 24 June 1994, Article 2(4) provides that: “the dwelling may include, as components thereof, premises, even if they are not directly adjacent to it or located within the limits of land property outside the building in which the dwelling is located; this include in particular: basement, cellars, box room, garage, hereinafter referred to as “corresponding spaces”.
The contract for the supply of energy to the dwelling is signed by you after the commissioning of the dwelling at POS of Innogy or another electricity supplier on the basis of a preliminary/developer contract and the commissioning protocol.

Perpetual usufruct
As stated in the preliminary/developer contract, you have undertaken to reimburse the perpetual usufruct fee from the time of signing the notarial deed until the end of the calendar year in which the notarial deed is signed.
The amount is calculated based on the following equation:
total fee paid by the Vendor for the perpetual usufruct related to the land on which the investment was made x the share of the dwelling you purchased in a common real estate (the surface of the dwelling together with the box room related to the total area of the common real estate) x the number of days remained until the end of the year following the signature of the deed.
